The terms for using deltagrapplingacademy.com, booking classes online, and receiving text messages from Delta Grappling Academy.

1 Agreement to these terms
These Terms of Service ("Terms") apply to your use of deltagrapplingacademy.com, operated by Delta Grappling Academy ("Delta," "we," "us" or "our"), 381 S 30th St, Unit I, Heath, OH 43056, and to the forms, chat widget, booking calendars and text messages connected to it.
By using the website, submitting a form or opting in to text messages, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the website.
2 Our website and services
Our website gives information about our classes, schedule, instructors and programs, and lets you ask questions, request a free trial week, book classes and request group self-defense workshops.
Taking part in classes, private lessons, memberships and workshops is governed by the liability waiver and any membership agreement you sign with us. If those documents conflict with these Terms, those documents control for the matters they cover.

Replies to your inquiry, class information, scheduling, enrollment, booking confirmations, reminders and schedule changes. Special offers, discounts and program announcements only if you opt in to marketing.
You can opt in to text messages from Delta Grappling Academy through:
The chat widget in the bottom right corner of every page, by checking a consent box.
The contact form at /contact, by checking a consent box.
The free trial form, reached from "Start free week" in the navigation bar and on the home page, by checking a consent box.
The group self-defense workshop request form at /self-defense-workshops, by checking a consent box.
Our booking calendars, reached from "Book now" on /programs or "Book your first class" on any program page, by checking a consent box.
The contact form, free trial form and workshop form each have two separate consent boxes: one for non-marketing messages and one for marketing messages. The booking calendars have one consent box for messages about your booking, and the chat widget has one consent box for non-marketing messages about your question. Every consent box is unchecked by default and optional, so you can send a form, chat or booking without checking any box. Consent to receive text messages is not a condition of purchasing any membership, class or service.

Marketing messages including special offers, discounts and program announcements, sent only if you checked the marketing consent box.
Frequency and cost
Message frequency varies based on your inquiry, bookings and the choices you made when opting in. Message and data rates may apply depending on your mobile plan. Contact your wireless carrier for details about your plan.
How to opt out
Reply STOP to any message to stop receiving texts. You can also reply CANCEL, END, QUIT, UNSUBSCRIBE or STOPALL. You will receive one message confirming you have been unsubscribed, and no further messages will be sent unless you opt in again. To start receiving messages again, reply START.
Replying STOP ends all text messages from our number, including booking reminders. If you only want to stop marketing messages, call or text us at (740) 504-1367 and we will update your preferences.
Carriers are not liable for delayed or undelivered messages.
By opting in, you confirm you are the account holder of the mobile number you provided or have the account holder's permission to use it.
If you change or give up your mobile number, please reply STOP from that number or let us know so we can update our records.
We may change or end the text message program at any time.
Privacy
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. See our Privacy Policy for details on how we handle your information.
4 Free week, bookings and workshops
The free trial week gives new students seven days of classes at no charge. We may change or end the free week offer at any time.
Class times and instructors can change. We will try to let you know about changes to a class you booked, but the schedule on our website is subject to change without notice.
A booking through our calendars reserves a spot in a class. If you cannot make it, please let us know so we can open the spot for someone else.
A self-defense workshop request is not confirmed until we agree on the date, time, location and any fees with you directly.
Pricing for memberships and lessons is discussed with you directly and is not offered through this website.
5 Training and physical risk
Martial arts training is physical and involves a risk of injury. Everyone must sign a liability waiver before taking part in a class, and a parent or guardian must sign for anyone under 18. Talk with your doctor before starting a new exercise program, especially if you have a medical condition or injury.

6 Acceptable use
When using our website, forms, chat or calendars, you agree not to:
Submit false information or someone else's contact details without their permission.
Send spam, harassing or unlawful content.
Try to interfere with, damage or gain unauthorized access to the website or the systems behind it.
Use bots or automated tools to scrape the site or submit forms.
7 Our content
The text, photos, logos and other content on this website belong to Delta Grappling Academy or are used with permission. You may view and share pages for personal, non-commercial use. You may not copy, sell or reuse our content for other purposes without our written permission.
8 Third-party sites and tools
Our website links to and embeds services run by other companies, such as Google Maps, Facebook, Instagram and partner organizations. We are not responsible for their content, policies or practices, and your use of them is governed by their own terms.
9 Disclaimers
We work to keep the website accurate and up to date, but it is provided "as is" and "as available," without warranties of any kind, to the fullest extent allowed by law. We do not guarantee the website will always be available, error-free or free of viruses.
10 Limitation of liability
To the fullest extent allowed by law, Delta Grappling Academy and its owners, instructors and staff will not be liable for any indirect, incidental, special or consequential damages arising from your use of the website, forms, chat, booking calendars or text messages. This section does not limit any rights you have that cannot be limited by law, and it does not replace the liability waiver that governs participation in classes.
11 Governing law
These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law rules. Any dispute about these Terms or the website will be brought in the state or federal courts serving Licking County, Ohio.
12 Changes to these terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Continuing to use the website or our text messages after an update means you accept the updated Terms.
